1. Parties
This Distance Sales / Service Agreement has been concluded electronically between the service provider whose details are set out below and the guest who makes a reservation through the Navoris Hotel website, booking engine, telephone, e-mail, or other means of distance communication.

Hereinafter referred to as the “Hotel” or the “Service Provider”.
1.2. Guest / Buyer
The natural or legal person who declares their name, surname, contact details, accommodation dates, room type, number of guests, payment information, and other required information during the reservation process. Hereinafter referred to as the “Guest” or the “Buyer”.
2. Subject of the Agreement
The subject of this agreement is to determine the rights and obligations of the parties regarding the accommodation reservation made by the Guest through the Navoris Hotel website, booking engine, telephone, e-mail, or other distance communication channels.
This agreement covers provisions relating to room reservation, accommodation service, payment, cancellation, modification, no-show, preliminary information, processing of personal data, and the mutual responsibilities of the parties.
3. Main Characteristics of the Service
The service subject to this agreement is the accommodation service provided by Navoris Hotel.
The main characteristics of the reserved service consist of the room type, accommodation dates, number of nights, number of guests, price, payment method, cancellation conditions, whether breakfast or other additional services are included, and similar information.
These details are also stated on the reservation screen, offer form, payment page, e-mail confirmation, or reservation confirmation document presented to the Guest during the reservation process.
Before completing the reservation, the Guest is responsible for checking the selected room type, accommodation dates, number of guests, price, payment terms, and cancellation conditions.
4. Formation of the Reservation
The reservation is formed when the Guest selects the relevant room, dates, rate, and payment conditions; enters the required personal and contact information; accepts the preliminary information, cancellation conditions, and this agreement; and completes the payment or payment guarantee process.
For the reservation to become final, it must be confirmed by the Hotel. The reservation confirmation may be sent to the Guest by e-mail, booking engine notification, written confirmation, or similar electronic communication methods.
The Hotel reserves the right to review, request correction, or cancel a reservation in cases of technical error, price display error, system failure, incorrect availability information, failure to receive payment, security suspicion, or similar justified reasons.
5. Price and Payment Terms
The reservation amount is determined according to the selected room type, accommodation dates, number of guests, rate plan, campaign, taxes, exchange rate differences, and any additional services.
Unless otherwise stated in the relevant reservation conditions, the total amount shown during the reservation process covers only the accommodation service subject to the reservation.
Payment may be made by credit card, debit card, virtual POS, bank transfer/EFT, payment at the hotel, or other payment methods accepted by the Hotel.
Depending on the reservation conditions, the Hotel may request prepayment, partial payment, full payment, credit card authorization, or payment guarantee.
For non-refundable, prepaid, or promotional reservations, payment may be collected at the time of reservation or at the time specified in the reservation conditions.
Banks, payment institutions, or third-party payment infrastructures may be used for payment transactions. The transaction and security rules of the relevant institutions apply to these processes.
6. Taxes and Additional Charges
Taxes and charges included in the reservation price are stated on the reservation screen or confirmation document.
Accommodation tax, VAT, city tax, extra person fee, child fee, breakfast, transfer, parking, minibar, laundry, late check-out, early check-in, or similar additional service fees may be charged separately depending on the reservation conditions.
No additional service shall be deemed included in the reservation amount unless it is expressly stated as included during the reservation process.
7. Check-in and Check-out Conditions
Guest check-in and check-out times are subject to the hotel policies stated during the reservation process.
As a general rule, check-in procedures are carried out from the hotel’s designated check-in time, and check-out procedures must be completed by the designated check-out time.
Early check-in and late check-out requests are subject to hotel availability and may be subject to an additional fee.
The Guest is required to present a valid identity document, passport, or any other documents requested under applicable legislation at check-in.
The Hotel reserves the right not to provide accommodation service if identity documents are not presented, reservation details cannot be verified, payment guarantee cannot be provided, or for security reasons.
8. Cancellation and Modification Conditions
Cancellation and modification conditions may vary depending on the selected rate type, campaign, room type, accommodation dates, and reservation channel.
The Guest is responsible for carefully reviewing the payment, cancellation, and modification conditions of the relevant rate plan before making a reservation.
For flexible reservations, the right to free cancellation or modification may be used until the final cancellation date specified in the reservation conditions. In the event of cancellation, modification, or no-show after the free cancellation period has expired, the amount stated in the reservation conditions may be charged.
For non-refundable or prepaid reservations, cancellations, modifications, or refunds are not possible once the reservation has been completed. Even if the stay does not take place, the full reservation amount or the portion specified in the reservation conditions may be charged.
Date change requests are evaluated subject to hotel availability and current rates. If a price difference arises for the new dates, the current rates shall apply.
For reservations made through online travel agencies or third-party platforms, cancellation and modification procedures are carried out through the platform where the reservation was made and in accordance with that platform’s rules.
9. No-Show
If the Guest does not check in on the reservation date and does not cancel the reservation within the allowed period, this shall be considered a no-show.
In case of no-show, the Hotel reserves the right to charge the first night’s fee or the total reservation amount, depending on the reservation conditions.
For non-refundable, prepaid, or special promotional reservations, the full reservation amount may be charged in case of no-show.
10. Right of Withdrawal
Although consumers generally have a right of withdrawal in distance contracts, accommodation services to be performed on a specific date or within a specific period are among the exceptions to the right of withdrawal under the applicable distance contracts rules.
Therefore, the Guest cannot benefit from the general 14-day right of withdrawal for hotel reservations made for a specific date range.
The Guest’s cancellation, modification, or refund rights are evaluated within the framework of the rate plan and cancellation conditions accepted at the time of reservation.
This provision does not eliminate the Guest’s other statutory rights arising from consumer legislation.
11. Force Majeure and Extraordinary Circumstances
In cases of natural disasters, epidemics, war, terrorism, strike, decisions of official authorities, transportation restrictions, fire, technical failure, security risk, or similar force majeure events beyond the control of the parties, the obligations of the parties may be re-evaluated according to the nature of the event.
In case of force majeure, the Hotel reserves the right to cancel the reservation, postpone it, offer alternative dates, re-evaluate payment conditions, or seek a mutual solution with the Guest.
12. Obligations of the Guest
The Guest accepts that the information provided during the reservation process is accurate, complete, and up to date.
The Guest is responsible for checking the reservation dates, room type, number of guests, price, payment terms, and cancellation conditions.
The Guest is required to act in accordance with general morality, security, peace, hygiene, and the rules of the property within the hotel.
The Guest is responsible for any damage caused to the hotel, rooms, furniture, technical equipment, or third parties.
During the stay, the Guest must comply with applicable legislation, identity notification obligations, hotel rules, and security instructions.
13. Obligations of the Hotel
The Hotel agrees to provide the accommodation service in accordance with the reservation conditions.
The Hotel takes care to provide the room type selected by the Guest during the reservation. However, in cases of operational necessity, technical failure, or similar circumstances, the Guest may be offered an alternative room in the same or higher category.
The Hotel is obliged to exercise reasonable care during the provision of the service and to take the necessary measures to ensure guest safety and service quality.
14. Protection of Personal Data
The Guest’s personal data is processed in accordance with the Turkish Personal Data Protection Law No. 6698 and related legislation.
Personal data may be processed for the purposes of receiving the reservation, providing the accommodation service, identity notification, payment, invoicing, communication, guest relations, fulfillment of legal obligations, and improvement of service quality.

15. Electronic Communication and Notifications
The Guest accepts that reservation confirmation, payment information, cancellation/modification notices, and accommodation-related notifications may be sent through the e-mail address, telephone number, or other communication channels provided during the reservation process.
Commercial electronic messages are sent in accordance with applicable legislation and, where required, subject to the Guest’s consent.
16. Complaints and Application Channels
The Guest may submit requests and complaints regarding reservation, payment, cancellation, modification, or accommodation service to the Hotel through the following channels:

In the event of a dispute, the parties shall first attempt to reach a solution in good faith through communication.
Guests who qualify as consumers may apply to Consumer Arbitration Committees or Consumer Courts within the monetary limits and procedures set out in the relevant legislation.
17. Governing Law and Jurisdiction
The laws of the Republic of Türkiye shall apply to any disputes arising from this agreement.
For consumer transactions, the competent Consumer Arbitration Committees and Consumer Courts shall have jurisdiction in accordance with the relevant legislation. In other cases, the competent courts and enforcement offices shall have jurisdiction.
18. Effectiveness
Before completing the reservation, the Guest declares that they have read and accepted this Distance Sales / Service Agreement, the Preliminary Information Form, the Privacy Policy, and the cancellation/payment conditions applicable to the reservation.
This agreement enters into force when the Guest gives electronic approval and completes the reservation.
The reservation confirmation, payment information, cancellation conditions, and the provisions of this agreement shall be evaluated together.
